FACEBOOK:: Mitt Romney, Rick Santorum, Newt Gingrich fight Facebook suit – POLITICO

The Romney, Santorum and Gingrich campaigns set aside their differences Friday to fire off a joint letter demanding a California techie drop his lawsuit against them over their Facebook pages.

Frank Weyer, a patent lawyer who also runs a company called EveryMD, late last month filed a lawsuit in Los Angeles federal court alleging that the Republican presidential candidates’ Facebook pages were infringing on a patent his company held related to business or group pages on social media websites.

The lawsuit alleges that 4 million Facebook users are violating EveryMD’s patent, but Mitt Romney, Rick Santorum and Newt Gingrich are the only named plaintiffs. Weyer had initially sued Facebook and MySpace for copyright infringement, prompting the companies to ask for a re-examination of the group’s patent by the U.S. Patent and Trademark Office, which rejected EveryMD’s claims.

Though EveryMD is appealing the office’s decision, it was enough to prompt a judge to dismiss the case against Facebook and MySpace – hence the long-shot suit against the presidential candidates and others.

In a letter sent Friday afternoon to Weyer and obtained by POLITICO, lawyers for Gingrich, Romney and Santorum wrote “we do not believe there is a good faith basis” for the suit. In fact, they assert, it seems like an effort “to circumvent the intent and effect of the Court’s earlier dismissal of virtually identical claims” in the suit against Facebook and MySpace.
